One of the objectives we have set together with FIHR members is to pursue updating the methodology regarding the use of phonograms by accommodation units.

To renegotiate the phonogram taxation methodology, FIHR signed a collaboration protocol with the CORECT Association, FPIOR and HORA Romania, on 04.08.2023, which requests the appointment of a negotiation committee with collective management organizations.

The committee's work ended in December 2023, without reaching an agreement with the collective management bodies, because the latter do not want to change the methodology. Thus, on 29.12.2023, the members who signed the protocol on behalf of the HORECA representatives filed a lawsuit through a specialized lawyer contracted for this purpose, as a follow-up to the outcome of the negotiation process.

To date, the collective management organizations' submissions have not been communicated, so the Court has not set the initial deadline for this case.

In parallel, the collective management bodies had deadlines in court, through which they requested the suspension of the ORDA decision to establish the negotiation committee. The file has not been finalized yet, being in the trial process, respectively the communication of objections.
